TERMS & CONDITIONS
Location: The Auction will be held on site. Registration will begin at 9:00 AM.
Tracts: The property will be offered in 2 tracts. Tract 1 includes 10+/- Acres which includes all of the structures. Tract 2 includes 8.5 +/- Acres fenced and cross fenced.
Inspection: The property is available to the public for inspection. Call Berry Land & Auction, LLC at 256-683-5800 to make an appointment with one of our agents to inspect the property. Also, The property will be open for inspection November 8th from 1:00 til 3:00 PM.
Down Payment: Successful Buyers will pay a 10% non refundable down payment at the auction and sign a Auction Real Estate Sales Contract. This is a cash sale. This sale is not contingent on the buyers ability to borrow money.
Buyers Premium: There is 10% buyers premium that will added to the final bid price to arrive at the contract purchase price.
Closing Cost: Buyers will be responsible for paying all closing cost, deed prep, recording fees and title insurance. Ad Valorem taxes will be prorated at closing.
Closing Date: Closing must occur on or before December 14th, 2009. Timing is of the essence.

Title: Title will be transferred by Warranty Deed. The current recorded legal description shall be used to transfer title.
Survey: All survey work will be performed by Rymeg and Associates, Scottsboro, AL Should the property sell in two separate tracts a survey will be required in order to establish legal descriptions for the tracts. The cost of such surveys will be paid for by the buyer. The survey price for Tract 1 is $1250.00, and the survey price for Tract 2 is $1250.00. Should the two tracts be combined into one sales contract, the property title will transfer as described in the current legal description recorded on the current property deed.
