Zoning: the parcel is in the Mv/Rl-5 (Morongo Valley/Rural Living with a 5 acre minimum) zone. The RL (Rural Living) land use zoning district provides sites for rural residential uses, incidental agricultural uses, and similar and compatible uses.

Permitted Uses: For Residential uses - Single Family Residence, Modular Home, Tiny House, and Manufactured Homes (over 10 yrs will require a Compatibility Determination prior to submitting a building permit.)

In addition to a primary single-family residence, a combination of two of the following additional accessory units would be allowed. Parcels five acres in size or greater shall be allowed to have three of the following. Please review the below Accessory Dwelling Unit Ordinance for sizing and additional information. However, the structure(s) will need to meet development standards (i.e. setbacks, lot coverage, etc).

· Accessory Dwelling Unit (1,200 sq ft max)

· Junior Accessory Dwelling Unit (one per parcel, 500 sq ft max)

· Guest House (no max sq ft, cannot be larger than the primary)

Legal Road Access? as per the SB County Land Use Services Department, they cannot confirm the physical access to the property. The Land Development Department needs an assigned letter by a land surveyor/engineer stating, there is physical access per SB county code.

What does the applicant do if the county cannot confirm legal access?

There are 3 options.

1. They can contact a title company to see if there are any easements that may establish legal access. The county cannot see all easements on their property so suggest research for legal access/easements from a title company.

2. Or they can sign the Hold harmless agreement which is an agreement that the property owner takes responsibility of any consequences for having no legal access.

3. Ask all the property owners leading up to the nearest county-maintained road to do a voluntary road dedication or easement for a public right of way.
